Update on the Buy Ontario Act, 2025

The Government of Ontario tabled the Buy Ontario Act, 2025 on November 20. The legislation aims to prioritize Ontario-made goods and services first, followed by Canadian options, within public-sector procurement.
We have now received confirmation that the Act has passed in the House and is awaiting Royal Assent from the Lieutenant Governor. While this step is largely procedural, it signals that the legislation is effectively finalized, and the next phase will focus on developing the supporting regulations.
At this stage, the Act provides a legal framework with limited detail and further directives are expected. Of note, the Act would repeal the Building Ontario Businesses Initiative Act, 2022, but the existing definition of an “Ontario business” (supplier, manufacturer, or distributor that conducts its activities permanently in Ontario and either has its headquarters in Ontario or has at least 250 full-time employees in Ontario at the time of a procurement process) is expected to remain in place at this time.
